OK - now in US v. Roman Storm, verdict watch Day 2 - Storm w/ Klein & Patton, Rehn at other table Unsealing bid Inner City Press 1st book on the case [2d soon] & will live tweet, thread below

As counsel on both side sit at their table waiting for the next jury note, here's letter that the defense put in about the transcripts jurors have request so far: "transcripts therefore should reflect exactly what the jury heard" - including sealed Dragonfly Q&A?

Still waiting on jury, only Axel and Storm at defense table; Judge Failla has ruled for US on transcript redactions except "regarding a portion of Mr. Werlau's testimony, the response "It wasn't me" should not be redacted because objection [was on] another issue"

All rise!
Judge Fialla: We've received another jury note, Is cooperation with foreign law enforcement required without a subpoena? I don't think that's something I should be answering on.
AUSA Rehn: We agree with that.
Judge: There are many treaties, anyway MLATs
Storm's lawyer Patton: I think we should answer "No."
Judge: But there's not evidence on this
Patton: The government put in evidence about the Taiwanese regulators request
Judge: Ah, I was thinking about the Dutch trip. Do I ask for the clarification?
AUSA: No
AUSA: We would have to investigate the duty to answer foreign authorities
Judge: I'm reluctant to amplify the record now
Storm's lawyer Patton: We could think of language like, Mr. Storm is not charged with anything relating to foreign governments
AUSA Rehn: There is evidence they received requests from foreign law enforcement.
Judge: There is nothing in this record that suggests that it was mandatory for Mr. Storm to cooperate with such request - is that accurate?
AUSA Rehn: Yes. But state of mind
Judge: I will say, No such evidence was admitted at trial... Consider my instructions on the law as a whole.
[Response was sent back into jury]
Wait on jury continues - will update

1:06 pm in courtroom:
3 Assistant US Attorneys stand together chatting, as do Storm's lawyers Klein and Patton. Apparently the jurors are deliberating through lunch: no break from possible notice and questions, or verdict, has been taken
1:09 pm
All rise!
Judge Failla: The jurors have asked for text messages. Taking an hour to respond is not going to make the jurors deliberate faster. I'll let you know: Juror 10 or 11, Ms. Nelson, there's a party for her tomorrow. & 4 must end this week
Judge Failla: I have a couple of matters Wednesday, Thursday and Friday, thinking that... I did not think you wanted me to tell them to come in earlier.
Storm's lawyer Klein: I think they should come in tomorrow, I don't know when the birthday party starts
Judge: What would a note to them look like? I don't want to rush them right now... Do you authorize me to speak with them? I could bring them out here
Storm's lawyer Klein: I remember this birthday party issue
AUSA: We'd say let's reassess at the end of today
Judge: When I was passing through the robing room I saw that one of our jurors Ms. Taylor had declined our offer of free food and was going out. So they are not deliberating, this would be the time. Ms. Noriega, you can speak with Ms. Nelson. Stay local
1:27 pm
Judge Failla: We have the worst of all world. The juror's mother's birthday party is an all day affair including a pedicure. We only learned this now. If we say no, you risk the ire of the jury. My deputy believes the best way is for me to go into the room
Judge Failla: I can tell them I have a sentencing later this week, and that other jurors have conflicts. And we do want them to sit for some portion of every day. I think the pedicure's got to go. And I'm so sorry to say that. I don't want to pick on her
Judge Failla: At some point Juror 4 is going to turn into a pumpkin and we'd have to start over. So let me go in there
Break as Judge Failla speaks to jurors (no to pedicure)

1:43 pm
Judge Failla: Ms. Nelson did tell the other jurors, and they said, let's not sit tomorrow. I told them, that's not possible. So they said they will sit from 8:30 am to midday. They are thinking of staying past 4. I have no sense of a verdict today
Break

All rise!
Judge Failla: We have received a note - the jurors say they will leave today at 4 pm and proposes to deliberate tomorrow to 12:30, then the next days to 3:45, Friday until 1 pm... I propose to just tell them, see you tomorrow
