This is dumb. The problem the UK has is that Parliament is given absolute power to ban anything it wants and it has used that power to erase civil liberties. British law needs a concept of an area of civic life which is off-limits to Parliament. That means a Bill of Rights.

A ‘British Bill of Rights’ is a terrible idea. One of the primary issues we have is that we have been asking judges to make value judgments, that belong in the political arena, not legal judgments. This is structural and wide-ranging, for example our disaster of an energy policy is similarly afflicted. It cannot be solved by ‘tighter’ drafting or ‘making it British’. We should return to the British constitutional norm of pre-1997, asylum and immigration are political judgments, not legal judgements. Power needs to return to Parliament.
